Strict liability for dog attack

December 12, 2024

Norman Lopes was working as a crossing guard when a vehicle operated by Emmanuella Koulouris drove through a “Do Not Enter” sign on the street. Lopes stopped the vehicle, and as he approached it, a pit bull terrier jumped out and lunged at him. He fell to the ground and suffered a fractured spine, necessitating physical therapy. He also suffered a knee injury and now has difficulty walking and driving. Lopes incurred medical expenses of approximately $26,500. He has been unable to return to work.

Lopes sued the dog’s owner, Anthony Dellano, alleging strict liability under state law.

The jury awarded $375,000, plus costs and interest.
