Failure to implement fall prevention measures

November/December 2024

Nora Tyler was admitted to The Birches at Newtown. At the time of her admission, she suffered from dementia and osteoporosis, and she had a history of transient ischemic attacks. Over the next few months, Tyler fell on various occasions, resulting in injuries including a head laceration, subdural hematoma, and a fractured clavicle and hip. She required surgery for the hip fracture and was subsequently diagnosed as having a blood clot, which also necessitated surgery.

Suit against One Newtown Properties, LP, and Heritage Senior Living, LLC, alleged improper monitoring, failure to implement fall prevention measures, and failure to timely recognize and diagnose Tyler’s injuries.

The parties settled for $175,000.
