Breach of warranty

Hi-Tech Aggregate, LLC, operates a mining and processing operation that sells gravel and sand, known as aggregate. Hi-Tech supplied Pavestone, LLC, with aggregate, which Pavestone used to manufacture pavers. After receiving multiple customer complaints regarding unsightly salt deposits or efflorescence on its pavers, Pavestone determined that sodium carbonate in the Hi-Tech aggregate led to the efflorescence when the pavers became wet.

Pavestone, LLC, sued Hi-Tech Aggregate, LLC, alleging negligence, breach of warranty, breach of contract, and products liability.

The court awarded more than $2.6 million, plus interest, attorney fees, and costs.
