Proposed Amendment to FRCP 35 - Compulsory Medical Exams (CMEs)

On January 12, 2026, AAJ filed a new suggestion to amend Rule 35 to address perceived abuses and inconsistencies in directed medical exams, which we refer to as compulsory medical examinations (CMEs), by allowing examinees to have a representative present and to record the exam, thereby increasing transparency, preventing improper questioning or harassment, and aligning federal practice with modernized state-court safeguards.
